Washington Desk, August 6. The U.S. Citizenship and Immigration Services (USCIS) has reinstated the authority of its officers to deny immigration benefit applications that are submitted without required supporting documents or sufficient evidence of eligibility. The revised policy has taken effect immediately and applies to both newly filed and pending applications.

According to the updated guidance, applicants are responsible for proving their eligibility at the time of filing and maintaining that eligibility until a final decision is made. If an application lacks the required initial evidence or fails to establish eligibility, USCIS officers may reject or deny it without first issuing a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID).

Under the previous policy, applicants who submitted incomplete documentation were generally given an opportunity to provide additional evidence after receiving an RFE or NOID. They were typically allowed up to 12 weeks to respond, with additional time granted for notices sent outside the United States.

USCIS stated that the revised policy is intended to strengthen the integrity of the immigration process and discourage the filing of intentionally incomplete applications. The agency said it had identified cases where applicants deliberately submitted incomplete petitions to obtain interim immigration benefits, such as employment authorization, while waiting for a decision.

Although officers now have broader discretion to deny incomplete applications, USCIS clarified that they may still issue an RFE if they believe additional evidence could resolve the deficiencies in a particular case.

Immigration experts believe the policy will increase the importance of filing complete and well-documented applications. Applicants are expected to ensure that all required forms, supporting evidence and eligibility documents are included before submission to avoid the risk of immediate denial.

The new guidance is expected to have a significant impact on individuals seeking visas, employment authorization, permanent residency and other immigration-related benefits through USCIS.
